Bazani Real Estate (“Bazani”, “we”, “our” or “us”) operates an online platform that provides property-related information and facilitates property discovery for buying, selling, renting and leasing properties.

These Terms and Conditions govern access to and use of the Bazani Real Estate website, its services and associated features.

By accessing or using our website, submitting a property listing, or expressing interest in a listed property, you agree to these Terms and Conditions. If you do not agree, please discontinue using the relevant services.

Bazani may update these Terms and Conditions from time to time, subject to applicable law. Updated terms will be published on the website with the applicable effective date.

For these Terms and Conditions:

Property owners and authorized representatives are responsible for ensuring that they have the right to advertise the property. Where applicable, the listing submitter must obtain the owner's consent and any necessary authorization from a lawful representative or agent.

Bazani may request ownership documents, authorization letters, identity or contact verification, or other relevant supporting records. Submitting a property does not establish ownership or create ownership rights in favour of the submitter.

Buyers and sellers are responsible for conducting appropriate due diligence before entering into a property transaction. The final sale price, payment arrangements, possession date, transfer of ownership and other conditions must be agreed by the relevant parties in a proper written agreement.

Bazani does not guarantee completion of a sale or the performance of any buyer, seller, agent or other third party. Users should obtain appropriate legal advice and execute necessary documents before making a purchase or transferring funds.

Property owners or authorized representatives must provide accurate rental information, including monthly rent, advance or security deposit, maintenance fees, availability, tenant eligibility restrictions, and rental duration.

Prospective tenants should inspect the property, verify the identity and authority of the person offering it, and confirm all financial and contractual conditions before making payments. Payment, adjustment and refund of deposits are governed by agreement between the parties and applicable law. Bazani does not guarantee that a property will remain available.

For lease properties, the relevant parties should clearly establish the lease amount, duration, payment schedule, refund conditions, possession arrangements and termination conditions. Users should independently verify the legal status of the property and the authority of the lessor. The parties are responsible for preparing and executing a legally appropriate lease agreement. Bazani is not a party to any lease agreement unless expressly agreed in a separate written contract.

Users must upload genuine property photographs and content that they are legally entitled to use. The following are prohibited:

• Photographs copied or used without authorization.
• Images unrelated to the listed property.
• Misleading photographs or descriptions.
• Content that infringes copyright, trademarks, privacy or other legal rights.
• False claims about facilities, location, pricing or property condition.

Bazani may remove content following a valid complaint, infringement claim or review. Users remain responsible for the content they submit.

Any listing fees, service charges, consultancy charges or other applicable fees will be disclosed separately where relevant. The website clearly identifies services for which payment is requested and applicable payment, cancellation and refund conditions.

Property sale consideration, rent, lease amounts, advances and security deposits are not payable to Bazani merely because a property appears on the website. Unless a separate written arrangement expressly provides otherwise, property-related payments are made directly between the transacting parties.

Property listings and other website content are provided to help users conduct their own initial research. Users must not treat published information as a substitute for independent verification, legal advice, financial advice or professional property inspection.

Unless expressly authorized, users must not reproduce, resell, redistribute or use website content to create a competing property listing database or service. All intellectual property rights remain with their respective owners.

The website may contain links to third-party websites, services or resources. Bazani does not control third-party websites and is not responsible for their independent content, policies, availability or practices. Users should review applicable terms and privacy policies before using third-party services.

To the extent permitted by applicable law, users are responsible for claims, losses or expenses arising directly from their unlawful conduct, fraudulent submissions, infringement of third-party rights or material breach of these Terms and Conditions. Any indemnification obligation will be subject to applicable law and will not remove rights or protections that cannot legally be waived.

Bazani will handle personal information in accordance with its published Privacy Policy and applicable data protection laws. Users must provide personal information lawfully and must have appropriate authorization before submitting another person's information.

Bazani may suspend, restrict or remove access to the website or its services where reasonably necessary, including for suspected fraud, unauthorized listings, security risks, repeated violations or legal compliance. Where appropriate and legally required, notice or an opportunity to respond may be provided.

Bazani may modify, suspend or discontinue website features or services, subject to applicable law and any relevant contractual obligations. Changes to these Terms and Conditions will be published on the website with an effective date. Users should review the terms periodically.

These Terms and Conditions shall be governed by the laws of India. The parties should first attempt to resolve disputes through good-faith communication. Any unresolved dispute shall be handled by the competent courts or other dispute-resolution mechanism applicable under Indian law.

If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law. Failure to enforce a provision on one occasion does not automatically waive the right to enforce it later.
